Terms of service

These Terms and Conditions shall apply to sales of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred to, offered, or relied on by the Buyer, whether in negotiation or at any stage in the dealings between the parties, including any standard or printed terms tendered by the Buyer, unless agreed to by the Seller in writing. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

By placing an order, the Buyer represents that they are at least 18 years of age and have the legal authority to enter into this Agreement.

I. Definitions

In this document the following words shall have the following meanings:

  • "Buyer" means the organization or person who buys the Goods.
  • "Goods" means all articles supplied to the Buyer by the Seller, including products manufactured by the Seller ("DISCO32 Products") and products manufactured by third parties and resold by the Seller ("Third-Party Products").
  • "DISCO32 Products" means Goods designed and manufactured by DISCO32, including but not limited to: Constant Able PTTs, U94 adapters, antenna systems, MSM systems, DISCUS kits, and related cables and accessories.
  • "Third-Party Products" means Goods manufactured by other companies and resold by DISCO32, including but not limited to products from 3M/Peltor, Gentex/Ops-Core, N-Ear, and other brands carried by DISCO32.
  • "Intellectual Property Rights" means all patents, registered and unregistered designs, copyright, trademarks, know-how, and all other forms of intellectual property.
  • "Seller" means DISCO 32 TACTICAL ANTENNAS, LLC, a North Carolina limited liability company, doing business as DISCO32.

II. Price and Payment

The price shall be the price listed at checkout at the time of purchase, unless otherwise agreed in writing between the parties. The price is exclusive of any applicable sales tax, excise tax, or use tax, which shall be added as required by law.

Payment is due at the time of purchase unless DISCO32 has extended written credit terms to the Buyer. Where credit terms have been agreed (e.g., Net 30), payment is due within the agreed period from the date of invoice. Late payments are subject to a service charge of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by North Carolina law (N.C. Gen. Stat. § 24-1), whichever is less.

DISCO32 reserves the right to suspend or cancel orders and revoke credit terms for any Buyer with an overdue balance.

III. Product Information

Product descriptions, specifications, images, and technical data on our website and marketing materials are provided for general reference and identification purposes. While we strive for accuracy, these materials do not constitute a guarantee of performance in any specific application or configuration. The Buyer is responsible for verifying product compatibility with their equipment prior to purchase. Contact help@disco32.com with compatibility questions before ordering.

IV. Order Acceptance and Delivery

Placement of an order does not constitute acceptance. A binding contract is formed only when the Goods are shipped or DISCO32 confirms the order in writing. DISCO32 reserves the right to refuse or cancel any order at its sole discretion, including but not limited to orders flagged for pricing errors, inventory shortages, suspected fraud, or suspected use of freight forwarding services.

Expedited shipping does not expedite manufacturing or processing time. Expedited shipping applies only to carrier transit time after the order has been processed and shipped.

Unless otherwise agreed in writing, the Goods shall be shipped to the address specified by the Buyer on the date estimated by DISCO32, or as close as possible to that date. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. DISCO32 is responsible only for delivering the Goods to the carrier for shipment. The risk of loss shall pass to the Buyer when the Goods are delivered to the carrier. This contract shall be F.O.B. Seller's place of business. Shortages, over-deliveries, and duplicated orders must be reported to DISCO32 within seven (7) days of signed receipt to enable replacement or refund.

DISCO32 ships within the United States only, including APO, AE, AP, FPO, and DPO addresses. See Section XIV for freight forwarding and export compliance terms.

V. Risk

Where the Buyer chooses to collect the Goods itself, the risk shall pass when the Goods are entrusted to the Buyer or set aside for the Buyer's collection, whichever happens first.

VI. Title

Title in the Goods shall not pass to the Buyer until the Seller has been paid in full for the Goods.

VII. Return of Unused Goods

All Goods are sold on a firm sale basis. DISCO32 will not accept returns unless otherwise agreed, in which case the following terms apply:

  1. Any return must be authorized in writing by DISCO32 before any credit will be given. Unauthorized returns will be refused.
  2. The Buyer must request return authorization within fourteen (14) days of delivery. The Buyer is responsible for all return shipping costs and must ensure returned Goods are carefully packaged to avoid damage in transit. DISCO32 is not obligated to accept Goods damaged in any way.
  3. Credit will only be given for Goods in sellable condition: unused, in original packaging, with all original tags and seals intact. Any tampering with or removal of the product seal or hygiene tag shall void return eligibility. DISCO32 reserves the right, at its sole discretion, to deny any return showing signs of wear, use, damage, or modification.
  4. Refunds for approved returns are issued to the original payment method within approximately ten (10) business days following inspection and approval. Refunds exclude original shipping charges and any non-recoverable transaction fees charged by the payment processor. A restocking fee of 15% applies to all authorized returns.
  5. Orders shipped to mail forwarding addresses are subject to the additional terms in Section XIV.

Hygiene and Safety Policy: For safety and hygiene reasons, all sales of tactical headsets, earplugs, helmets, visors, microphones, and related accessories are FINAL. These items cannot be returned or exchanged once worn, fitted, or used. Items that have been in contact with the ear, head, or face cannot be resold. Inspect all items carefully upon receipt. Contact help@disco32.com with questions before purchase. This policy does not limit your rights under the product warranty in Section X.

Pre-Orders: All pre-orders are final and cannot be canceled. Pre-order items are clearly identified at checkout and in the cart. Pre-order items may have extended lead times. Contact help@disco32.com for estimated delivery dates.

VIII. Support and Troubleshooting

All support and warranty requests begin with a DISCO32 Troubleshooting Ticket. This form must be completed in full before any support, warranty claim, or return authorization can be processed.

Our products interface with dozens of radio platforms, headset configurations, and accessory combinations. The troubleshooting ticket captures your exact setup, symptoms, and isolation steps so our engineering team can diagnose the issue accurately. It also helps us track failure patterns across production runs.

All troubleshooting submissions must include clear photographs or video demonstrating the issue. Submissions without visual documentation may be delayed or denied.

Once an RMA is authorized:

  • Domestic orders: DISCO32 will provide a prepaid return label for valid warranty claims. The label must be used within fourteen (14) days or the RMA is void.
  • Orders shipped to forwarding addresses: The Buyer is responsible for all return shipping costs. The Buyer has fourteen (14) days from RMA authorization to ship the item and provide tracking to help@disco32.com. After fourteen days, the RMA is void.

No ticket, no support. No exceptions.

IX. Return of Defective Products

DISCO32 Products:

If a DISCO32 Product is found to be defective within fourteen (14) business days of delivery, the Buyer shall promptly notify DISCO32 at help@disco32.com. The notice shall state in detail the specific nature of the defect and include supporting evidence, including photographic or video documentation. The Defective Product shall, at DISCO32's sole discretion, be replaced or repaired per the warranty terms in Section X. The Buyer shall follow DISCO32's instructions for the disposition or return of the product. Defects discovered after fourteen (14) business days but within the Warranty Period are handled under the warranty process in Section X.

Third-Party Products:

If a Third-Party Product purchased from DISCO32 is found to be defective within fourteen (14) business days of delivery, the Buyer shall notify DISCO32 at help@disco32.com. DISCO32 will assist the Buyer in initiating a warranty claim with the original manufacturer, including providing proof of purchase and coordinating communications. The warranty obligation, replacement timeline, and final resolution are determined by the original manufacturer.

X. Limited Warranty

DISCO32-Manufactured Products:

DISCO32 warrants its manufactured products against defects in materials and workmanship for a period of one (1) year from the date of original purchase ("Warranty Period"). Dated proof of purchase is required. If a DISCO32 Product fails due to a manufacturing defect during the Warranty Period, DISCO32 will, at its option, repair or replace the product at no charge for parts or labor. Repairs are warranted for thirty (30) days or the remainder of the original Warranty Period, whichever is longer.

This is a LIMITED WARRANTY covering manufacturing defects only. The following are not covered:

  • Bent, broken, or damaged connector pins
  • Cables pulled from or ripped out of connectors
  • Crushed or cracked connector housings
  • Cut, frayed, or overstretched cables
  • Water damage to products not rated as waterproof
  • Modifications or repairs by anyone other than DISCO32
  • Damage from accident, neglect, abuse, misuse, or improper handling
  • Damage from acts of nature, power surges, or environmental exposure
  • Labor charges for installation or removal
  • Normal wear and consumable items (earpads, windscreens, O-rings)

REPAIR OR REPLACEMENT IS THE BUYER'S SOLE AND EXCLUSIVE REMEDY UNDER THIS WARRANTY. DISCO32 SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR BUSINESS INTERRUPTION, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY.

To the extent permitted by the Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301–2312) and the North Carolina Uniform Commercial Code (N.C. Gen. Stat. Ch. 25, Article 2), the duration of any implied warranty of merchantability or fitness for a particular purpose is limited to the duration of this express limited warranty. Some states do not allow limitations on the duration of implied warranties, so this limitation may not apply to you.

Third-Party Products:

THIRD-PARTY PRODUCTS ARE COVERED EXCLUSIVELY BY THE ORIGINAL MANUFACTURER'S WARRANTY. DISCO32 DOES NOT INDEPENDENTLY WARRANT THIRD-PARTY PRODUCTS. EXCEPT FOR THE ASSISTANCE DESCRIBED IN SECTION IX, THIRD-PARTY PRODUCTS ARE PROVIDED "AS IS" TO THE FULLEST EXTENT PERMITTED BY LAW.

If a Third-Party Product purchased from DISCO32 fails within the manufacturer's warranty period, contact help@disco32.com. DISCO32 will assist in navigating the manufacturer's warranty process, including providing proof of purchase and coordinating return logistics where possible. The warranty terms, timeline, and resolution are set by the manufacturer.

Warranty Claims on Orders Shipped to Forwarding Addresses:

Warranty coverage applies regardless of where the product is ultimately used. Orders shipped to mail forwarding, re-shipping, or virtual mailbox addresses are subject to the following with no exceptions:

  • All warranty claims require photographic or video documentation before a return is authorized. DISCO32 reserves the right to resolve claims through remote diagnosis without requiring a physical return.
  • The Buyer is responsible for all shipping costs associated with the warranty claim, including return shipping to DISCO32 and delivery of any replacement or repaired product. DISCO32 does not provide prepaid labels for orders shipped to forwarding addresses.
  • DISCO32 is not responsible for customs duties, import taxes, brokerage fees, or any other charges incurred during the warranty process.
  • Replacement or repaired products will not be shipped until the original item is received and inspected, unless waived at DISCO32's sole discretion.

XI. Intended Use and Assumption of Risk

DISCO32 products are designed for use by trained professionals in communications, law enforcement, military, and related fields. The Buyer acknowledges that tactical communications equipment is used in demanding and potentially hazardous environments. The Buyer assumes all risk associated with the selection, use, and performance of the Goods in their intended or actual application. DISCO32 makes no representation that any product is suitable for any specific mission, operation, or life-safety application. The Buyer is solely responsible for determining the fitness of any product for their intended use.

XII. Limitation of Liability

DISCO32 SHALL NOT BE LIABLE UNDER ANY SECTION OF THIS AGREEMENT OR UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST REPUTATION), WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH LOSS IN ADVANCE. THIS EXCLUSION INCLUDES LIABILITY ARISING FROM THIRD-PARTY CLAIMS AGAINST THE BUYER. IN NO EVENT SHALL DISCO32 BE LIABLE FOR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS BY THE BUYER. IN NO EVENT SHALL DISCO32'S TOTAL LIABILITY UNDER THIS AGREEMENT EXCEED THE AMOUNT ACTUALLY RECEIVED FROM THE BUYER FOR THE PRODUCT INVOLVED.

This limitation does not exclude liability for personal injury or death caused by DISCO32's negligence, or any liability that cannot be excluded under North Carolina law (N.C. Gen. Stat. Ch. 99B).

XIII. Government and Agency Sales

Sales to federal, state, or local government agencies, including purchases made under GSA Schedule, blanket purchase agreements, or other government contract vehicles, may be subject to additional terms and conditions as required by applicable regulations, including the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS). In the event of a conflict between these Terms and the terms of a government contract or purchase order accepted in writing by DISCO32, the government contract terms shall prevail. Standard return, warranty, and support policies apply to government sales unless otherwise specified in a written agreement.

XIV. Freight Forwarding, Export Compliance and International Orders

Shipping Policy:

DISCO32 ships within the United States only. Our products require hands-on technical support across dozens of radio and headset configurations. Providing warranty diagnostics, troubleshooting, and RMA processing internationally is not operationally viable. We will not sell products we cannot properly support.

Buyers outside the United States should contact help@disco32.com for a referral to an authorized distributor in their region.

APO, AE, AP, FPO, and DPO addresses are treated as domestic U.S. orders with full warranty and support. Buyers shipping to military addresses remain subject to all applicable U.S. export laws and regulations.

Mail Forwarding, Re-Shipping and Virtual Mailbox Services:

Orders identified as shipping to a mail forwarding, re-shipping, or virtual mailbox address are subject to the following terms. These terms are non-negotiable. DISCO32 will make no exceptions for orders shipped to forwarding addresses.

When DISCO32 identifies a forwarding service on an order, the Buyer will be notified by email and given the option to cancel the order for a full refund before shipment. The order must be canceled before it ships. Once the order has shipped, these terms are in effect and the cancellation window is closed. Processing times vary.

By proceeding with an order shipped to a forwarding address, the Buyer agrees:

  1. The Buyer is responsible for all shipping costs, including return shipping on warranty claims, repairs, and any other returns. DISCO32 does not provide prepaid return labels for orders shipped to forwarding addresses.
  2. The standard return window and all delivery-based deadlines begin when the carrier confirms delivery to the forwarding address. Transit time from the forwarding address to the Buyer's final destination, customs processing, and forwarding service handling time do not extend any window or deadline under this Agreement.
  3. Product warranty remains valid per Section X, subject to the forwarding address warranty terms therein. All warranty claims require photographic or video documentation.
  4. DISCO32 is not responsible for customs duties, import taxes, brokerage fees, transit delays, package seizures, or any costs or losses incurred after the package leaves DISCO32's facility.
  5. Certain products may not be available for orders shipping to forwarding addresses. Items that cannot be fulfilled will be canceled and refunded. The remainder of the order will ship under these terms.

DISCO32 reserves the right to cancel any order identified as using a forwarding service at its sole discretion.

Export Compliance:

These items may be controlled by the U.S. Government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end-user identified herein. They may not be resold, transferred, or otherwise disposed of to any other country or to any person other than the authorized ultimate consignee or end-user, either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations.

Certain products sold by DISCO32 may be subject to the Export Administration Regulations (EAR) and the International Traffic in Arms Regulations (ITAR). Unauthorized export or re-export is a violation of federal law. By placing an order, the Buyer certifies that they are purchasing for lawful use within the United States or a U.S. territory, and that they will not export, re-export, or transfer the Goods in violation of U.S. export control laws. DISCO32 screens orders against the OFAC Specially Designated Nationals (SDN) list and other restricted party lists. Orders flagged for sanctioned destinations or denied parties will be canceled and reported as required by law.

XV. Intellectual Property Rights

All Intellectual Property Rights produced from or arising as a result of the performance of this Agreement shall, so far as not already vested, become the absolute property of DISCO32, and the Buyer shall do all that is reasonably necessary to ensure that such rights vest in DISCO32 by the execution of appropriate instruments or the making of agreements with third parties.

XVI. Force Majeure

DISCO32 shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, terrorism, pandemics, epidemics, government actions or sanctions, supply chain disruptions, carrier delays, material shortages, fire, flood, or natural disasters, and DISCO32 shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as DISCO32 considers unreasonable, it may, without liability on its part, terminate the contract.

XVII. Electronic Communications

By placing an order, the Buyer consents to receiving electronic communications from DISCO32 related to the order, including order confirmations, shipping notifications, policy updates, warranty correspondence, and compliance notices. The Buyer agrees that electronic communications satisfy any legal requirement for written notice.

XVIII. Privacy

DISCO32 collects, uses, and protects personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By placing an order, the Buyer consents to the collection and use of their information as described in the Privacy Policy.

XIX. Dispute Resolution

The parties agree to attempt resolution of any dispute arising from this Agreement through good-faith negotiation before initiating litigation. If negotiation is unsuccessful within thirty (30) days of written notice, either party may proceed with litigation per Section XXI.

XX. Severability

If any term or provision of these Terms and Conditions is held invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal, or unenforceable provision eliminated.

XXI. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. The parties specifically agree that the exclusive jurisdiction and venue for any legal proceedings, claims, disputes, or litigation arising out of or relating to this Agreement or the purchase of Goods shall be in the state or federal courts located in Moore County, North Carolina. The Buyer hereby consents to personal jurisdiction in such courts and waives any objection based on inconvenient forum.

XXII. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Buyer and DISCO32 with respect to the purchase of Goods and supersede all prior agreements, representations, and understandings, whether written or oral. No modification shall be binding unless agreed to in writing by an authorized representative of DISCO32.

Your Acceptance of These Terms

By using this site, you signify your acceptance of these Terms and Conditions. If you do not agree, please do not use our site or place an order. Your continued use of the site following the posting of changes to these terms will be deemed your acceptance of those changes.
