Terms of service
These Terms and Conditions shall apply to sales of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred to, offered, or relied on by the Buyer, whether in negotiation or at any stage in the dealings between the parties, including any standard or printed terms tendered by the Buyer, unless agreed to by the Seller in writing. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
I. DEFINITIONS
In this document, the following words shall have the following meanings:
- “Buyer” means the organization or person who buys the Goods;
- “Goods” means the articles to be supplied to the Buyer by the Seller;
- “Intellectual Property Rights” means all patents, registered and unregistered designs, copyright, trademarks, know-how, and all other forms of intellectual property;
- “Seller” means DISCO 32 TACTICAL ANTENNAS, LLC., a North Carolina corporation.
II. PRICE AND PAYMENT
The price shall be the Recommended Retail Price, unless otherwise agreed in writing between the parties. The price is exclusive of VAT or any other applicable costs, sales tax, excise tax, or use tax.
III. DESCRIPTION
Any description given or applied to the Goods is provided for identification only and shall not constitute a sale by description. For the avoidance of doubt, the Buyer affirms that it does not rely on any description when entering into the contract.
IV. DELIVERY
Unless otherwise agreed in writing, the Goods shall be shipped to the address specified by the Buyer on the date estimated by the Seller, or as close as possible to that date. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever tendered for delivery. The Seller is responsible only for delivering the Goods to the carrier for shipment. The risk of loss shall pass to the Buyer when the Goods are delivered to the carrier. This contract shall be F.O.B. Seller’s place of business. Shortages, over-deliveries, and duplicated orders must be reported to the Seller within three (3) days of signed receipt to enable replacement or refund.
V. RISK
Where the Buyer chooses to collect the Goods itself, the risk shall pass when the Goods are entrusted to the Buyer or set aside for the Buyer’s collection, whichever occurs first.
VI. TITLE
Title in the Goods shall not pass to the Buyer until the Seller has been paid in full for the Goods.
VII. RETURN OF UNUSED GOODS
The Seller shall not take back goods manufactured by a party other than the Seller, whether defective or not. Products manufactured by outside suppliers and added to Seller’s products are subject to the warranties of the outside supplier, not the Seller, and must be returned to the manufacturer, not the Seller.
All Goods are sold on a firm sale basis, meaning the Seller will not accept returns of any Goods sold to the Buyer unless otherwise agreed in writing by the Seller.
Hygiene & Safety Policy:
For your safety and ours, all sales of tactical headsets, earplugs, helmets, visors, microphones, and accessories are FINAL and cannot be returned or exchanged for any reason. Once these items have been worn, fitted, or used—whether in or on your ears, head, or face—they cannot be resold due to hygiene and contamination risks. We aim to ensure every customer receives a fresh, unused product, so please inspect your items carefully before use. Questions should be directed to help@disco32.com prior to purchase.
Pre-Sales:
All pre-sales are final and cannot be canceled for any reason. Please review your pre-sale order carefully before confirming, as we are unable to accommodate cancellations once a pre-sale is completed. Contact us at help@disco32.com with any concerns before finalizing your pre-sale.
If the Seller agrees to accept returns under exceptional circumstances, the following terms apply:
- Returns must be authorized by a Seller representative before any credit is issued, within 14 days of shipment receipt;
- Where the Seller agrees to accept undamaged Goods, the Buyer shall bear the cost of carriage and ensure careful packaging to prevent transit damage. The Seller is not obligated to accept damaged Goods and will only accept returns listed in the Seller’s current Publication List;
- Credit will only be issued for Goods in sellable condition—unused and in original packaging. The Buyer shall incur a 15% restocking fee, plus transaction fees charged by the merchant service used for the purchase, including returns due to hardware incompatibility;
- Re-Shipping & Forwarding: Orders fulfilled using re-ship, package forwarding, or virtual mailbox services to circumvent international shipping policies are NULL AND VOID. These items are sold "AS IS," with no refund, return, or warranty service offered. (See Section XV for details).

VIII. RETURN OF DEFECTIVE PRODUCTS
If a Seller-manufactured product is found defective (“Defective Product”) within fourteen (14) business days of receipt, the Buyer shall promptly notify the Seller via email or fax. At the Seller’s discretion, the Defective Product will be replaced, and the Buyer shall follow the Seller’s instructions for its disposition or return. This policy applies only to products manufactured by the Seller, not third-party products incorporated into Seller’s Goods. Defective items from third-party manufacturers are subject to their warranties and must be returned to them directly. If an item is defective out of the box, it will be addressed separately (e.g., via warranty or replacement), but not after use.
IX. LIMITATION OF LIABILITY
The Seller shall not be liable under any section of this Agreement or under any contract, negligence, strict liability, or other legal or equitable theory for any indirect, special, incidental, or consequential damages of any kind (including, without limitation, lost profits or lost reputation), whether or not advised of such possibility in advance. This exclusion includes liability arising from third-party claims against the Buyer. In no event shall the Seller be liable for costs of procurement of substitute Goods by the Buyer, nor shall the Seller’s total liability exceed the amount actually received from the Buyer for the product involved.
X. WARRANTY
DISCO 32 TACTICAL ANTENNAS, LLC MANUFACTURED ITEMS:
DISCO 32 TACTICAL ANTENNAS, LLC warrants its products to be free of defects in material and workmanship for one (1) year from the date of original purchase (“Warranty Period”). Dated proof of purchase, such as a bill of sale, is required to establish eligibility. If a product fails due to a defect during the Warranty Period, the Seller will, at its option, repair or replace it with the same or a comparable item at no charge for parts or labor. Repairs are warranted for 30 days against the same defect or for the remainder of the original warranty, whichever is longer.
This warranty excludes: (a) damage from acts of nature (e.g., lightning, wind, flood); (b) damage from accident, neglect, abuse, misuse, improper installation, or mishandling; (c) damage from alteration or repair by an unauthorized agent; (d) labor charges for installation/removal; and (e) non-rechargeable batteries, consumables, and normal wear parts. Repair or replacement is the Buyer’s exclusive remedy under this warranty. The Seller shall not be liable for any loss or damage, including direct, special, incidental, or consequential damages, resulting from the use or inability to use the product.
NON-DISCO 32 TACTICAL ANTENNAS, LLC MANUFACTURED ITEMS:
Except as provided herein, such products are sold “as is,” with all faults, and without warranty of any kind. The Seller disclaims all other warranties, express, implied, or statutory, including warranties of title, merchantability, fitness for a particular purpose, and non-infringement.
INTERNATIONAL WARRANTY DISCLAIMER:
All warranties are valid only for the original purchaser within the United States. International export of the product immediately voids all warranties.
XI. INTELLECTUAL PROPERTY RIGHTS
All Intellectual Property Rights arising from this Agreement shall become the absolute property of the Seller, and the Buyer shall assist as reasonably necessary to vest such rights in the Seller.
XII. FORCE MAJEURE
The Seller shall not be liable for delays or failures to perform due to events beyond its reasonable control, including acts of God, strikes, accidents, war, or material shortages, and shall be entitled to a reasonable extension of its obligations. If the delay persists unreasonably, the Seller may terminate the contract without liability.
XIII. SEVERABILITY
If any provision is held invalid, illegal, or unenforceable, it shall be severed, and the remaining provisions shall remain in effect.
XIV. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. The parties specifically agree that the exclusive jurisdiction and venue for any legal proceedings, claims, disputes, or litigation arising out of or relating to this Agreement or the purchase of Goods shall be in the state or federal courts located in Moore County, North Carolina. The Buyer hereby consents to personal jurisdiction in such courts.
XV. EXPORT COMPLIANCE & INTERNATIONAL ORDERS
1. United States Only
We exclusively sell and ship to end-users within the United States.
2. Zero Tolerance for Re-Shipping
Any order identified as using a freight forwarding service, package re-shipper, or virtual mailbox to facilitate unauthorized export is a violation of these Terms and Conditions.
- Order Cancellation: We reserve the right to cancel any order at our sole discretion if we suspect the use of such services.
- Warranty & Support Voided: Items shipped to a freight forwarder or re-shipping address are strictly sold "AS IS." Once the package is delivered to the US-based address on the order, our liability ends. All warranties, guarantees, returns, and technical support are immediately and permanently VOIDED if the item is subsequently taken or shipped outside the United States.
3. Authorized International Channels
Do not attempt to circumvent our shipping policies. If you are located outside the United States, you must purchase from our network of authorized distributors in your home country.
- These distributors are uniquely authorized to handle import compliance, warranty claims, and technical support for your region.
- Buying from a US-only listing via a re-shipper bypasses these authorized channels and leaves you with an unsupported product.
4. No International Support
We cannot and will not provide any form of support—including warranty claims, returns, exchanges, or troubleshooting—for items located outside the USA. We will not ship replacement parts or accept returns from international addresses under any circumstances.
5. Regulatory Compliance
Certain products are subject to U.S. export control laws (e.g., ITAR, EAR). Unauthorized export is prohibited. Buyers certify compliance with these regulations when purchasing restricted items. The Seller is not responsible for import duties, taxes, additional shipping costs, or losses incurred by Buyers outside the U.S.
